Terms & Conditions for Domain Registration
These Terms & Conditions govern the relationship between [Domain Provider Name] ("Provider") and you ("Customer") for domain registration and related services. Please replace the placeholders (in square brackets) with your company details before publishing.
1. Definitions
- Provider: [Domain Provider Name], the company providing domain registration services.
- Customer: The individual or legal entity purchasing or managing a domain through the Provider.
- Registrar / Registry: The ICANN-accredited registrar or the registry where the domain is ultimately registered.
2. Service Scope
The Provider acts as an intermediary to register domain names on behalf of the Customer, manage renewals, transfers, and optional add-on services (privacy protection, DNS management, email forwarding). The Provider does not guarantee a specific registry outcome beyond successful registration confirmation.
3. Domain Availability & Registration
- Registrations are processed on a first-come, first-served basis.
- A domain is considered registered only after confirmation from the registrar and full payment.
- The Provider is not responsible if a domain is unavailable at the time of processing due to registration races or registry policies.
4. Payment Terms & Refunds
- Full payment is required before initiating registration.
- Fees disclosed to the Customer include registration and any chosen add-ons; renewal fees may differ.
- Unless otherwise required by law, payments are non-refundable after successful registration. If registration fails and the Provider cannot complete the order, a full refund will be issued.
5. Domain Ownership
After successful registration and payment, the Customer is the registrant (owner) of the domain for the paid term, subject to registry rules and ICANN policy. The Customer must maintain accurate contact details in WHOIS and notify the Provider of any changes immediately.
6. Renewal & Expiry
- The Customer is responsible for renewals prior to the expiry date.
- The Provider will send renewal reminders, but is not liable for domain loss due to non-renewal.
- Expired domains may enter registry grace or redemption periods and may incur additional redemption fees.
7. Transfer Policy
- Domain transfers to other registrars follow ICANN transfer rules and typically require unlocking the domain and providing an EPP/Auth code.
- Domains cannot be transferred within 60 days of initial registration or a prior transfer, as per ICANN policy.
8. Prohibited Use
The Customer agrees not to use the domain for illegal activities including but not limited to fraud, phishing, distribution of malware, or infringement of intellectual property rights. Violation may lead to suspension or cancellation.
9. Suspension & Cancellation
- The Provider may suspend or cancel services if the Customer violates these Terms, provides false WHOIS data, or if suspension is required by law or a court/registry.
- The Provider will notify the Customer where feasible before suspension unless prohibited by law.
10. Liability & Disclaimer
The Provider's liability is limited to direct damages caused by proven gross negligence. The Provider is not liable for indirect, incidental, special, or consequential damages (including lost profits or data). Services are provided "as is" without additional warranties.
11. Domain Disputes
Any third-party disputes regarding domain ownership or trademark issues will be resolved under the Uniform Domain-Name Dispute-Resolution Policy (UDRP) or the registry's dispute resolution procedures. The Provider is not a party to disputes between registrants and third parties.
12. Privacy Protection (WHOIS)
If WHOIS privacy is purchased, the Provider will replace the Customer's publicly visible contact information with the privacy service's contact. The real registrant data may be disclosed if legally required or per registry rules.
13. Governing Law & Jurisdiction
These Terms are governed by the laws of [Your Country / State]. Any disputes will be resolved in the courts of [Your City / Jurisdiction], unless otherwise agreed in writing.
14. Changes to Terms
The Provider may update these Terms from time to time. The Provider will notify Customers of material changes; continued use of services following notice constitutes acceptance of the updated Terms.
